Terms of Service
All projects undertaken by TK Digital Studio Ltd will be subject to the following terms and conditions. Any agreements made that are different to the terms and conditions will have to be made in writing and signed by TK Digital Studio ltd and the client.
These terms and conditions and any issues with them are governed by the laws of England and Wales, as TK Digital Studio Ltd operate in the United Kingdom. Therefore, courts of England and Wales have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims).
TK Digital Studio Ltd is a product photography company registered in England.
The Client is a person or organisation ordering services from TK Digital Studio Ltd.
Our working hours are Monday to Friday, 9 am to 5:30 pm. Turnaround times are always based on our working days. The best time to contact us is during these hours.
TK Digital Studio Ltd charges per hour. This includes communication, preparation, shooting, editing, and any other additional work requests. This also includes time taken for research, location scouting, travel time, packing equipment, etc.
Terms and Conditions Changes
We may change these Terms. Our website will include the date of the latest change if the Terms have been revised.
Before the project begins, it is necessary for TK Digital Studio Ltd to have a clear written description of the desired shoot, product details, ideal outcome, the services being purchased, and any other details that may be requested for clarification by TK Digital Studio Ltd at the time to ensure an efficient working process.
All the products sent to TK Digital Studio Ltd must arrive at least 1 day before the shoot and in good condition. The client should send the sample in perfect condition, otherwise it will cost extra time to fix in post-production.TK Digital Studio Ltd receives most products through mail services. If there is loss or damage during transit, the client must make claims for compensation to the courier service, not TK Digital Studio ltd. Clients may want to insure high-value products. The delivery and return of products are charged to the client.
TK Digital Studio Ltd is not responsible for any loss of profits, sales, or business, or any other losses that arise from the Studio’s use of the product in photography or the client’s use of the delivered photos/services. TK Digital Studio’s ltd total liability to the client is limited to the price of the client’s order. Products may get damaged during the process of the photo or video shoot.
TK Digital Studio Ltd will start working on your project on the agreed date. In the unlikely case of delay, TK Digital Studio Ltd will not take any responsibility or provide compensation if the cause is not under the control of TK Digital Studio Ltd (e.g., sickness). If extreme and unprecedented events occur, such as war, natural disaster, fire or any other event which would make impossible to work in our studio then TK Digital Studio ltd is not contractually obliged to provide the service.
TK Digital Studio Ltd will follow the client brief. If the client requests further rework, that will be charged on a per hour basis. If TK Digital Studio Ltd made an error, such as misunderstanding the brief, the delivery will be fixed for no cost.
After the job is done, the Studio will send a watermarked preview to the client. There is a 3-day window for the client to provide feedback so we can make changes if required. Changes are part of the process and are charged using our hourly rate.
Approval and payment
After TK Digital Studio Ltd shows the watermarked images for approval, the client is expected to pay via Bank Transfer. The prices of our services are VAT exclusive (VAT is 20%). When all charges for all services provided have been paid, we will release the unwatermarked photos to the client, which counts as the final delivery. TK Digital Studio Ltd works on per hour basis any additional work or changes requested will be charged.
After the payment has been received in full, for all the services ordered, TK Digital Studio Ltd will offer a full license for commercial purposes, online and in print. You can use the image to promote your company, its products, and its services. We do not limit the use of our images nor ask for additional payment for licenses. The only limitations apply to photographs using stock assets, please see section Composite photography.
Marketing and Promotional Materials
The client agrees that images and designs created can be used for marketing and promotion by TK Digital Studio Ltd unless otherwise agreed.
To create a composite photograph, we need to buy a licensed stock photograph from the stock agencies. In the invoice, the Studio will explain where the photographs have been licensed from and what kind of license has been used. You are responsible for making sure that the license fits your needs. Therefore, we recommend reading the license terms.
Work Outside of Working Hours
Requests made outside TK Digital Studio’s working hours will only be available if the Studio is free. They may cost extra.
Fees are charged for late-notice shoot cancellation. The notice period is 10 days. If the cancellation is made less than 10 days before the shoot, charges will apply. If the cancellation notice is given between 10 and 3 business days prior to the shoot, there will be a charge of 50% of the quote for the shoot cost. If the cancellation notice is given less than 3 business days prior to the shoot, there will be a charge of 75% of the quote for the shoot cost.
If payment is not made by the due date, there will be 3 reminders sent to the client. After those 3 reminders, if the payment has not been cleared, we reserve our statutory right to claim interest and compensation for debt recovery costs under the Late Payment of Commercial Debts Act of 1998. Until all payments have been cleared, including interest and any other additional costs associated with recovery, we reserve the right to not provide any further services to the client.
